Terms of Service

These Terms of Service form an agreement between you and Fruition International Ltd (company number 15518353), which operates Fame Factor. Its registered office is 44 Kirkgate, Ripon, England, HG4 1PB. They apply when you create an account, buy a subscription or use the Fame Factor website, learning platform or game.

If you create or manage accounts for an organisation, you confirm that you have authority to accept these terms for it. If you do not agree, do not create an account or use the service.

Fame Factor may ask for reasonable evidence of age, authority or consent if needed to protect a learner or comply with law. We do not ask children for a date of birth as part of the basic age gate.

• Users aged 13 or over may create an individual learner account.
• A child under 13 must use the parent or family route and must not submit their own email address to create an independent account.
• A parent, guardian, teacher, school or centre may create and supervise learner accounts for children in their care or instruction.
• You must provide accurate information and have legal capacity and authority for the account you create or manage.

Keep login details secure and tell us promptly about suspected unauthorised access. Account owners are responsible for activity under their account unless it results from our failure to use reasonable care.

Schools, teachers and centres must have a lawful basis and appropriate authority to create learner accounts, provide relevant privacy information, keep class membership accurate and respond to learner or parent requests where they are the controller. Managed learner credentials must be shared only with the intended learner and supervising adults.

Adults responsible for children must provide appropriate supervision and follow their safeguarding duties. Fame Factor is a learning service, not an emergency or confidential safeguarding channel. If a child may be at immediate risk, contact the appropriate emergency or safeguarding service.

• Use Fame Factor only for lawful learning, teaching and account-management purposes.
• Do not bully, threaten, impersonate or attempt to identify another child; upload harmful or unlawful material; or misuse support and feedback tools.
• Do not defeat security, scrape or overload the service, introduce malware, reverse engineer protected parts, share paid access outside the agreed group, or use bots, exploits or account sharing to manipulate scores or rewards.
• Only upload a screenshot or other support material if you have permission and it is necessary. Remove unrelated personal or sensitive information first.

Prices and billing periods are shown before purchase. Paid subscriptions normally renew automatically each month using the payment method held by Stripe until cancelled. You can cancel through the Stripe customer portal; cancellation takes effect at the end of the current paid period and access continues until then unless we tell you otherwise.

Nothing in these terms removes rights that cannot lawfully be excluded. This includes any applicable cooling-off, cancellation, refund, quality or digital-content rights under UK consumer law. Refunds are provided where required by law and may otherwise be considered fairly in the circumstances. Contact support if you believe a payment is incorrect.

Payment-card details are collected and held by Stripe, not Fame Factor. Trials, beta access and promotional prices may have separate end dates or eligibility rules shown when offered.

Virtual coins, rewards, badges and cosmetic items are part of the learning experience. They are licensed for use within Fame Factor, have no cash value, cannot be exchanged for money or property and may not be sold or transferred. We may adjust them to correct errors, protect fair play or rebalance the service, acting reasonably.

Fame Factor and its licensors own the platform, game, branding, software, questions, graphics and other service content. We give you a limited, non-exclusive, non-transferable and revocable right to use the service for its intended personal or educational purpose while your account is active.

You retain ownership of material you submit. You give us permission to host, reproduce and process it only as needed to operate, secure and support the service. Feedback may be used to improve Fame Factor without identifying you.

We aim to provide a reliable service, but do not promise uninterrupted or error-free access. We may maintain, repair, update or change features, including learning content and game balance. We will take reasonable care and give reasonable notice of a material reduction to a paid service where practicable.

You may stop using Fame Factor and cancel a subscription at any time. We may restrict or suspend access where reasonably necessary to protect a child, user, service or third party; investigate suspected misuse; comply with law; or address non-payment. For serious or repeated breach, we may end the account after proportionate notice unless urgent action is needed.

When an account ends, access stops and personal information is handled under the Privacy Notice. Sections intended to continue—including payment, ownership, liability and dispute terms—remain effective.

We do not exclude or limit liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.

Subject to that, Fame Factor is provided for educational support and does not guarantee a particular exam result, grade or learning outcome. If you use Fame Factor for business or organisational purposes, we are not responsible for indirect or consequential loss, lost profit, lost revenue or lost data that could reasonably have been avoided by maintaining appropriate backups. Any other cap or exclusion will apply only to the extent fair and lawful in the circumstances.

These terms are governed by the law of England and Wales. If you are a consumer, you may also benefit from mandatory protections and bring proceedings in the courts available under consumer law where you live.

Our Complaints Policy explains how to raise a concern. We may update these terms for legal, security, service or business reasons. We will publish the new version and give prominent notice before a material change takes effect. Existing account owners and independent learners may be asked to accept replacement terms; managed learners are covered by the supervising adult or organisation.
